Explanation of Policies and Forms - Nonresident Students
The Fairview School District does not accept nonresident students from other school districts.
The Pennsylvania school code provides for free school privileges in
the school district of residence. Residency is established and
maintained where a student lives, sleeps and spends a majority of their
time. When a student is residing at a residence that is not owned or
rented by the parent / guardian, or where the parent / guardian has
relinquished custodial rights, both the resident and parent / guardian
must complete and sign, in the presence of a notary, the appropriate
district forms. These forms must be provided to the Principal or
Assistant Principal of the school building where the student will
attend.
The Board reserves the right to verify the claims of residency,
dependency and guardianship of any student and to require a sworn
statement of residential support for the student who resides with a
person other than his/her parent/guardian/custodian. If a nonresident
student’s claim is invalid or if information contained in the sworn
statement of residential support is found to be false, the student shall
be removed from school attendance in accordance with Board policy.
Notwithstanding any other provision of law to the contrary, a person
who knowingly provides false information in the sworn statement for the
purpose of enrolling a child in a school district for which the child is
not eligible commits a summary offense and shall, upon conviction for
such violation, be sentenced to pay a fine of no more than three hundred
dollars ($300) for the benefit of the school district in which the
person resides or to perform up to two hundred forty (240) hours of
community service, or both. In addition, the person shall pay all court
costs and shall be liable to the school district for an amount equal to
the cost of tuition calculated in accordance with section 2561 during
the period of enrollment.
A parent / guardian has relinquished guardianship of a student on a permanent basis
When a parent / guardian has relinquished guardianship of a student
to a resident of the Fairview School District, both the parent /
guardian and resident must complete district forms, and be present with a
notary when the forms are signed.
